Limitations of Liability
In no event shall CedarHVAC.com or any of its subsidiaries or affiliates be liable for any indirect, special, incidental, or consequential damages including but not limited to loss of use, loss of data, loss of business, or profits.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Some items may not comply with California Proposition 65.
Prices
Prices are subject to change without notice. CedarsHVAC.com is not responsible for typographical errors.
Warranty Limitations
Except as specifically set forth therein, CedarsHVAC.com makes no warranties, express or implied, and disclaims all other warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, and conformity to models or samples. Some states do not allow limitations on implied warranties so these limitations might not apply to you. The warranties set forth herein give you specific legal rights and you may have other rights that vary from state to state. Manufacturers’ warranties for exported products may vary or may be null and void for products exported outside the United States.
Payment Terms
Terms of payment are within CedarsHVAC.com’s sole discretion, and unless otherwise agreed to by CedarsHVAC.com, payment must be received by CedarsHVAC.com prior to CedarsHVAC.com’s acceptance of an order.
Payment for the products will be made by credit card or wire transfer unless otherwise specified by CedarsHVAC.com. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. CedarsHVAC.com may invoice parts of an order separately. Orders are not binding upon CedarsHVAC.com until accepted by CedarsHVAC.com. Any quotations given by CedarsHVAC.com will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law.
Shipping Charges/Taxes/Delivery
Separate charges for shipping and handling will be shown on CedarsHVAC.com’s invoice(s). You are responsible for all applicable sales and other taxes associated with the order. If applicable, a separate charge for taxes will be shown on CedarsHVAC.com’s invoice. CedarsHVAC.com will not be responsible for delays in delivery due to events beyond its control, including shortage of materials, labor strikes, transportation failures, or acts of God.
Return Policy
Returns can be subject to a 15% restocking fee. Please contact us within 14 days of receiving your order and we will issue your RMA # once the return is approved.
Title/Risk of Loss
Title to products and risk of loss passes from CedarsHVAC.com to you upon delivery to the carrier.
Components
Unless you are purchasing a remanufactured product, the product you purchase contains components that are new or equivalent to new in accordance with industry standards.
Amendments/Applicable Law
These terms and conditions may not be amended except by a formal written agreement signed by both parties. The laws of the State of Florida shall govern this agreement.
Export and/or Legal Restrictions (including for international transactions)
Exportation of this commodity or technology from the United States must be in accordance with the Export Administration’s regulations. Diversion contrary to U.S. law is prohibited. In the case where these commodities or technologies were to be transshipped, by confirmation of this order you are agreeing that you are in accordance with the U.S. Export Administration’s regulations.
Account Termination
We reserve the right to suspend or terminate your account or refuse service for any reason, including but not limited to: fraudulent activity, violation of these Terms, abuse of our return or refund policies, chargeback fraud, or use of our services for any unlawful purpose. You may close your account at any time by contacting [email protected].
Governing Law and Jurisdiction
These Terms and any dispute arising out of or related to your use of cedarshvac.com or any purchase from CedarsHVAC.com / Benavente Ventures LLC are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any legal action shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

If you have a concern about an order, product, or service, please contact us first at [email protected] or (305) 850-6693 — we resolve the vast majority of issues quickly when contacted directly. If a dispute cannot be resolved informally, you agree to attempt mediation before initiating any formal legal action.
Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, applicable law, or business practices. The most current version is always posted at cedarshvac.com/terms-and-condition/. We will indicate material changes by prominent notice on the site or by email to customers with active accounts. Your continued use of cedarshvac.com or placement of any order after we post updates constitutes your acceptance of the revised Terms.
